The contract between the company Stalè of N.Charbonnier and the customer is concluded with the acceptance of the order by the company Stalè. This acceptance is considered tacit, unless otherwise communicated in any way to the customer.
The customer, by placing an order in the manner provided, declares that he has read all the information provided to him during the purchase process and fully accept the general conditions and payment.
The customer, once the online purchase process, will print or save an electronic copy and still keep these general conditions of sale in accordance with the provisions of Articles. 52 and 53 of Legislative Decree no. 206/2005 on distance selling.
1. PRODUCTS: PRICES AND FEATURES
Save where otherwise indicated, the prices of published products are inclusive of VAT. The prices of the products published from time to time cancel and replace the previous ones and are subject to the actual availability of the products. The company Stalè reserves the right to confirm or change the prices of products published on its website or in brochures and advertising material at the time of confirmation of the customer's order.
Product images are indicative and non-binding.
The products are not supplied for testing. Although Stalè's operators can provide information on the characteristics of the products, the customer is responsible for the choice of the products ordered and the compliance and conformity of the specifications indicated to their needs.
2. ORDERS
All purchase orders for products sent to the company Stalè must be complete in all their parts and must contain all the elements necessary for the proper identification of the products ordered. Each order of products sent to the company Stalè constitutes a contractual proposal of the customer and, therefore, will be binding on the company Stalè only if confirmed by the same for acceptance. The execution of the order by the company Stalè, is equivalent to confirmation and acceptance of the same.
The Stalè company reserves the right not to accept incomplete orders, not properly completed. In case of non-execution of the order by the company Stalè (if the same is due to unavailability of products ordered by the customer) The company Stalè will inform the customer as soon as possible.
3. PAYMENT MODE
The terms of payment that Stalè applies to its customers are as follows:

3.1 PAYMENT BY BONIFICO ADVANCED BANK
In case of payment by bank transfer in advance, what the customer ordered will be kept busy until receipt of proof of transfer, to be sent to the company Stalè by fax 0121909177 or e-mail info@stale.It within 48 hours from the order.
The sending of the order will take place only after the verification of the actual crediting of the amount due on the current account of the company Stalè.
The reason for the transfer must include: the reference number of the order, the date of order; name and surname of the holder of the order.

3.2 PAYMENT IN CONTRAST
On delivery of the goods ordered, the customer can pay the amount, directly to the courier, in cash or by bank draft.
3.3 PAYMENT WITH CREDIT CARD
We accept all cards belonging to the following circuits: Visa, MasterCard, American Express.
Service available online on secure server Paypal.
In cases of purchase of goods with credit card payment methods, at the same time as concluding the online transaction, the bank of reference will charge the amount related to the purchase made.
In case of cancellation of the order by the customer or in case of non-acceptance of the same by the company Stalè, will be required simultaneously by the latter the cancellation of the transaction and the return of the amount committed.
The time of return, for some types of cards, depend solely on the banking system.
Once the transaction has been cancelled, in no case can the company Stalè be held responsible for any damage, direct or indirect, caused by the delay in the failure to release the 'amount committed by the banking system.
The company Stalè reserves the right to request additional information from the customer (eg. landline phone number) or sending copies of documents proving the ownership of the card used. In the absence of the required documentation, the company Stalè reserves the right not to accept the order.
At no time during the purchase process the company Stalè is able to know the information relating to the buyer's credit card, transmitted via secure connection directly and exclusively to the site of the bank that manages the transaction.
No computer file of the company Stalè will keep such data.
In no case can the company Stalè therefore be held responsible for any fraudulent, improper use of credit cards by third parties, upon payment of products purchased on its sites.
4. SHIPMENTS AND BILLING
All goods are sent with receipts, if the customer wants to receive an invoice, must communicate by email (info@stale.it) this decision at the same time as the purchase. For this purpose, it is essential to provide a valid VAT and tax number.
For the issuance of the invoice, the information provided by the customer at the time of ordering will be taken into account.
No change in the invoice will be possible after the issuance of the same.
5. SHIPPING EXPENSES
Shipments will be carried out by carriers defined by the company Stalè.
The cost of transportation will be calculated based on the weight/volume ratio of the items ordered
.
Shipping costs are understood to be due and payable by the customer, even if the same exercises the right of withdrawal, or refuses or returns to the sender, for any reason, the goods regularly ordered.
The shipping costs for the return of the goods to our warehouse are still borne by the customer.
In the latter case, the customer will have to provide for the reimbursement of these shipping costs, and possibly, in case of non-payment of the same, the company Stalè will take legal action for the recovery of this credit.
6. DELIVERY TIME
Purchases will be shipped by the company Stalè within 30 days (subject to availability) of receipt of your order by post or courier.
In any case the company Stalè is not liable for damages due to delays in processing the order or in delivering the ordered goods.
The goods are deemed to have been delivered when they leave the warehouses of the Stalè company and travel at the risk and peril of the customer even if sold free of charge.
Save explicit indication from our customer service, the delivery is intended at street level.
7. WHAT TO DO AT THE RECEIPT OF GOODS
At the time of delivery of the goods the customer is required to check:
- That the number of packages delivered corresponds to that indicated in the transport document
- That the packaging is intact and not altered even in the closing tapes
- In case of tampering and / or breakage or any doubt about the integrity of the goods, the customer must immediately dispute the shipment and / or delivery by writing
"I ACCEPTED WITH RESERVE" with the reason and then sign.
- The customer must subsequently report any damage or discrepancy within 7 (seven) days of receipt of goods. If the customer does not collect within 5 (five) working days the goods ordered and stored at the warehouses of the courier and / or the company Stale because of the repeated inability to deliver to the address specified by the customer at the time of order, the same order will be canceled.
Once the delivery receipt has been signed, the customer will not be able to object to the external characteristics of the delivery.
8. WARRANTIES
All products sold by Stalè are covered by warranty. In case of malfunction, malfunction or failure of the item purchased, the customer can contact us directly by sending an email to 'email address commerciale@stale.it. The product must be returned by the customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, etc. ..). To limit damage to the original packaging, we recommend, when possible, to put it in a second box, should be avoided in all cases the affixing of labels or adhesive tapes directly on the original packaging of the product.

If the lack of conformity does not result in a lack of conformity, the customer will be charged for any verification and restoration costs incurred by Stalè.
No damage can be claimed from Stalè for any delay in carrying out repairs or replacements.

9. RIGHT OF WITHDRAWAL
The sales of this site are subject to the right of withdrawal pursuant to /art. 64 of Legislative Decree 206/05.
The customer who intends to exercise the right of withdrawal must send, within 10 (ten) working days of receipt of goods, registered letter with acknowledgment of receipt. and must contain:
- the manifestation of willingness to take advantage of the benefits granted by law;
- an indication of the product concerned;

To obtain a refund of the amount paid, within the same period of 10 (ten) days from receipt of goods, the customer must also return to the sender by post or courier the product in respect of which he intends to exercise the right of withdrawal complete with any relevant sales invoice.
Within 30 (thirty) days from receipt of the communication in which the customer expresses the willingness to exercise the right of withdrawal, the company Stalè will refund by bank transfer or deposit on postal account.
The above refund refers only to the price of the product, in any case, the incidental costs of shipping and home delivery will not be refunded and, therefore, will remain the responsibility of the customer.
The right of withdrawal is still subject to the following conditions:
- the right applies to the product in its entirety;
- you can not exercise the withdrawal only on part of the product;
- the goods purchased must be intact and not damaged in any way and returned in the original packaging perfectly sealed, complete in all its parts (including packaging and any documentation and accessories: manuals, etc.).
The shipment, until the certificate of receipt in the warehouse of the company Stalè is under the complete responsibility of the customer, in case of damage to the goods during transport the company Stalè will notify the customer of the incident (within five working days of receipt of the goods in their stores), to allow the same to file a timely complaint against the carrier. In this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal.
The right of withdrawal expires completely, for lack of the essential condition of integrity of the goods (packaging and / or its contents), in cases where the company Stalè ascertains: the lack of the outer packaging and / or the original inner packaging, the absence of integral elements of the product (accessories, manuals, parts, etc..In the event of forfeiture of the right of withdrawal, the company Stalè will return to the customer the goods purchased charging the same shipping costs.
Note Bene: Customers who purchase with a VAT number cannot exercise their right of withdrawal.
10. COMPETENT HOLE
Without prejudice to the applicability of any mandatory provisions of law for the protection of consumers (as defined pursuant to Article 1 letter b) of Legislative Decree no. 185 of 22 May 1999), any dispute arising out of these terms of sale, will be referred to the exclusive jurisdiction of the Court of Turin.
Within the meaning and for the purposes of Articles 1341 and 1342 of the Civil Code, the customer declares that he has carefully read and understood and specifically accepts the following clauses of the conditions of sale of the company Stalè.1, 2, 3, 3.1, 3.2, 3.3, 4, 5, 6, 7, 8, 9 and 10.
